Terms and Conditions: Skyway Express Shopping & Shipping
1. Acceptance of Terms
1.1 By accessing our services, you agree to be bound by these Terms and Conditions; if you do not agree with any part of these terms, you may not use our services.
2. Services
2.1 Skyway Express offers shopping and shipping services, including purchasing and delivering goods on the customer's behalf, and reserves the right to modify services without prior notice.
3. User Accounts
3.1 Users are responsible for account confidentiality and all activities therein; you must provide accurate and complete information during registration.
4. Ordering and Payment
4.1 Orders are placed via our website where all fees are specified; payments are processed securely, and no credit card data is stored.
4.2 Shipments are delivered only after full payment of shipping charges; if payment is declined, items are held for 7 days before disposal or destruction.
5. Package Weights and Dimensions
5.1 Parcels are weighed using high-precision devices, with costs based on the higher of actual or volumetric weight.
5.2 The "True Weight" feature allows payment by actual weight in specific countries, excluding packages exceeding 50 inches (127 cm) in total linear dimensions (L+W+D).
6. Shipping and Delivery
6.1 Delivery times are estimates subject to external factors; customers are responsible for address accuracy, and Skyway Express is not liable for delays or non-delivery due to incorrect information.
7. VAT, Taxes, and Fees
7.1 International parcels are subject to taxes; while some addresses are tax-exempt, others will clearly indicate applicable VAT or purchase taxes.
7.2 Customs fees (typically 10% of the shipment value) are paid by the customer to the Iraqi government; any difference in the actual customs charge will be billed to the customer or credited to their account wallet.
7.3 An Electronic Export Information (EEI) form is mandatory for parcels exceeding USD 2,500, which must be shipped via DHL or FedEx.
8. Returns, Refunds, and Damages
8.1 Returns are only permitted for prohibited/dangerous materials or items damaged during transit from the merchant to our centers; we reserve the right to refuse returns in other circumstances.
8.2 For shipments under $1,000, insurance (10% of invoice value) is required for compensation; loss or damage is reimbursed based on the following scale:
Order Value ≤ $200 → Compensation: 25% of order value.
Order Value $201 – $1000 → Compensation: 10% of order value.
Order Value $1001 – $2000 → Compensation: 7.5% of order value.
Order Value > $2000 → Compensation is processed via shipping partners (FedEx/DHL) per their policies. 8.3 Compensation is only paid after official confirmation of loss or damage by the company or shipping partner.
9. Intellectual Property
9.1 All website content (text, logos, images) is the property of Skyway Express; any use without written consent is strictly prohibited.
10. Limitation of Liability
10.1 Skyway Express is not liable for any direct, indirect, or consequential damages resulting from the use of our services.
11. Governing Law
11.1 These Terms are governed by the laws of the United States and Iraq; any disputes shall be resolved within the courts of these two jurisdictions.
12. Changes to Terms
12.1 Skyway Express reserves the right to update or modify these Terms and Conditions at any time without prior notice.
13. Payments and Orders
13.1 Customers bear 100% responsibility for the accuracy of information entered into our automated system; orders cannot be canceled or refunded after one day of submission.
13.2 If an item’s price is lower than paid, the balance is credited to your Wallet; if higher, we will either use your available Wallet balance or refund the initial payment to your Wallet for resubmission.
13.3 Shipping fees are exclusive of government taxes and VAT; all such fees must be paid prior to or upon delivery.
14. Definitions
14.1 Package: Any parcel under one shipping label.
14.2 Shipping Waybill: The label generated by a courier under limited liability.
14.3 Dangerous Goods: Items classified as hazardous, flammable, or explosive by law.
15. Prohibited Items
15.1 Skyway Express will not ship hazardous materials, jewelry, currency, government IDs, or animals. Prohibited items will be forfeited or destroyed; full details at: skywayex.com/prohibited-materials/.
15.2 Users confirm they are not on any international blacklists and that shipments do not involve restricted entities or destinations.
16. "Shop" and "Ship" Service Rules
16.1 Shopping: Orders include product price and service fees but exclude international shipping, customs, or insurance.
16.2 Shipping: Customers must provide tracking numbers and PDF invoices; shipping charges are calculated upon warehouse arrival and must be paid online.
17. Misuse of Services
17.1 Misuse of services or reputation damage may result in fines between $50 and $500, legal action, and a permanent ban.
18. Shipping Limitations
18.1 We do not support domestic shipping within the warehouse's country, nor do we ship to any country other than Iraq.
19. Limited-Service Areas (LSA)
19.1 Shipments from LSA are shipped as received without inspection, consolidation, or repackaging, and are strictly non-returnable.
20. Wallet Terms
20.1 Wallet funds can be withdrawn at any time subject to a 10% withdrawal fee, following budget and account verification.
21. Storage and Disposal
21.1 Shipments are stored free for 30 days. Items will be destroyed if fees are unpaid, storage exceeds 30 days without movement, or if the shipment contains prohibited materials.
